Single Bench of High Court not subordinate to its Divisional Bench

Patna High Court has held that Division Bench of a High Court cannot exercise its power of superintendence, under Article 227 of the Constitution of India, against an order made, in a suit, by a Single Bench of the High Court. Division Bench comprising of Acting Chief Justice I.A. Ansari and Justice Chakradhari Sharan Singh observed that single Judge or a single Bench of a High Court is not a court subordinate to the Division Bench of the High Court.

Distinction between “Loss to the Estate” and “Loss of Estate”

A subtle but fundamental distinction between “Loss of Estate” and “Loss to the Estate” was discussed in Omana P.K. and others v. Francis Edwin and others (2011 (4) KLT 952). This Judgment was challenged before the Apex Court, which has now dismissed the Appeal.
